Shipping & Returns
Important: Please read this policy carefully before placing your order. By completing a purchase on embirikos.com or through any Embirikos sales channel, you acknowledge that you have read, understood, and agree to be bound by the terms set forth below. This policy is incorporated into and forms part of our Terms of Service.
Shipping, Returns & Refund Policy
1. Shipping
1.1 Processing & lead times
Ready-to-ship items are shipped the following business day. Made-to-order and customized items are shipped within the time frame specified on each product listing. Much of our current collection is made to order and will ship between two (2) to four (4) weeks after the order is placed. For bespoke and heirloom redesign commissions, please refer to the Custom & Heirloom Redesign page for detailed production timelines.
1.2 Domestic shipping
For the New York metropolitan area, we offer complimentary two-day delivery on in-stock items. Domestic shipping rates and delivery estimates for other regions are displayed at checkout.
1.3 International shipping
International shipping rates vary by destination and are calculated at checkout. Import duties, taxes, and customs fees are the sole responsibility of the buyer and are not included in the purchase price or shipping cost. All international purchases are final sale (see Section 3 below).
1.4 Signature confirmation & delivery
All orders are shipped with full tracking. For any order with a value of $500 or above, signature confirmation upon delivery is required. We may, at our discretion, require signature confirmation on any order regardless of value. If you or your designated recipient are unavailable to sign, the carrier will follow its standard redelivery or hold-at-location procedure. Embirikos is not responsible for any delay caused by a failed delivery attempt due to the recipient being unavailable to sign.
1.5 Transfer of risk & title
Title to and risk of loss for all products passes to the buyer upon confirmed delivery. “Confirmed delivery” means the carrier's tracking record shows the package as delivered and, where signature confirmation was required, a signature has been obtained. Once delivery is confirmed, the item is the sole property and responsibility of the buyer. Embirikos shall have no liability for any loss, theft, damage, or destruction of the item after confirmed delivery, regardless of the cause.
1.6 Shipping insurance
For orders valued at $1,000 or above, Embirikos includes shipping insurance at no additional cost to the buyer. This insurance covers loss or damage that occurs during transit (i.e., before confirmed delivery). In the event of a transit loss or damage claim, the buyer must notify Embirikos within forty-eight (48) hours of the estimated delivery date by emailing ariana@embirikos.com. Embirikos will work with the carrier and insurer to resolve the claim. Shipping insurance does not cover loss, theft, or damage that occurs after confirmed delivery.
2. Returns & refunds
2.1 Eligible returns
If you are not completely satisfied with your purchase of a ready-to-ship, non-customized item, you may request a return within fourteen (14) calendar days of confirmed delivery, subject to all of the following conditions:
- The item must be unworn, undamaged, unaltered, and in its original condition with all original packaging, certificates, and documentation.
- The item must not show any signs of wear, scratching, tarnish, or exposure to chemicals, perfumes, or moisture.
- The buyer must contact ariana@embirikos.com to obtain a Return Authorization (RA) number before shipping the item back. Returns sent without an RA number will not be accepted.
- The buyer is responsible for return shipping costs and must use a fully insured, trackable shipping method with signature confirmation. Embirikos is not responsible for items lost or damaged during return transit.
- Refunds will be processed to the original payment method within ten (10) business days of Embirikos receiving and inspecting the returned item. Embirikos reserves the right to deduct from the refund amount if the item does not meet the above conditions.
2.2 Final sale items (no returns or refunds)
The following categories of purchases are final sale and are not eligible for return, refund, exchange, or credit under any circumstances:
- Made-to-order items
- Customized or personalized items
- Bespoke and heirloom redesign commissions
- International purchases
- Items returned after the fourteen (14) day return window
- Items that have been worn, altered, damaged by the buyer, or are missing original packaging or documentation
2.3 Exchanges & store credit
For eligible returns within the fourteen (14) day window, you may choose a full refund to the original payment method, an exchange for a different item, or store credit. Exchanges are subject to product availability. If the exchange item is of greater value, the buyer is responsible for the difference. If of lesser value, the difference will be issued as store credit.
3. Loss, theft & damage after delivery
Once an item has been confirmed as delivered (per Section 1.5), Embirikos bears no responsibility for loss, theft, damage, or destruction of the item, regardless of how it occurs. This includes, without limitation:
- Items lost by the buyer after delivery
- Items stolen from the buyer after delivery (including porch theft)
- Damage caused by the buyer, a third party, or any event after delivery
- Any claim that the item was misplaced, lost, or otherwise no longer in the buyer's possession after confirmed delivery
Loss, theft, or damage of an item after confirmed delivery does not constitute grounds for a return, refund, exchange, credit, or payment dispute (chargeback) of any kind. Buyers are strongly encouraged to obtain their own personal property or jewelry-specific insurance for high-value purchases.
4. Payment disputes & chargebacks
By completing a purchase, the buyer agrees that if a dispute arises regarding their order, they will first contact Embirikos directly at ariana@embirikos.com to attempt resolution before initiating any payment dispute, chargeback, or claim with their bank or payment provider.
Embirikos reserves the right to contest any chargeback or payment dispute that it believes to be invalid, fraudulent, or inconsistent with this policy. In the event of a disputed transaction, Embirikos will submit all available evidence to the payment processor and card network, including but not limited to:
- Proof of delivery with signature confirmation
- Records of the buyer's acknowledgment and acceptance of this policy at checkout
- Order confirmation emails, correspondence, and communication records
- Product photographs and descriptions from the listing
- Any publicly available evidence of the buyer's receipt, use, or satisfaction with the item (including but not limited to social media posts, reviews, or testimonials)
- AVS and CVV verification records, 3D Secure authentication results, and IP address logs
Filing a fraudulent chargeback, including claiming an item was not received when delivery has been confirmed, or claiming an item was lost when evidence of receipt and use exists, may constitute fraud under applicable federal and New York State law. Embirikos reserves the right to pursue all available legal remedies, including recovery of the merchandise value, chargeback fees, legal costs, and any other damages, against any buyer who initiates a chargeback that Embirikos reasonably determines to be fraudulent.
5. Checkout acknowledgment
At checkout, all buyers are required to affirmatively acknowledge that they have read, understood, and agree to this Shipping, Returns & Refund Policy by checking a mandatory acknowledgment box. This acknowledgment is recorded and stored as evidence in the event of any future dispute. Completing a purchase without checking this box is not possible.
By checking the acknowledgment box, the buyer specifically confirms:
- They have read and agree to this Shipping, Returns & Refund Policy in its entirety.
- They understand that title and risk of loss transfers to them upon confirmed delivery.
- They understand that loss, theft, or damage after delivery is not grounds for a return, refund, or chargeback.
- They agree to contact Embirikos directly before initiating any payment dispute.
- They understand and accept the final sale terms for made-to-order, customized, bespoke, and international purchases.
6. Recommended buyer protections
Embirikos strongly recommends that buyers of fine jewelry take the following steps to protect their investment:
- Obtain personal property insurance or a jewelry-specific insurance policy (such as through Jewelers Mutual or a homeowner's/renter's insurance rider) that covers loss, theft, and damage.
- Retain all certificates of authenticity, appraisals, and purchase documentation provided by Embirikos.
- Photograph items upon receipt and store documentation in a safe location for insurance purposes.
7. Governing law & dispute resolution
This policy and all transactions conducted through embirikos.com shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising out of or relating to this policy or any Embirikos transaction that cannot be resolved through direct communication shall be subject to the exclusive jurisdiction of the state and federal courts located in Kings County (Brooklyn), New York.
8. Severability
If any provision of this policy is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
9. Modifications
Embirikos reserves the right to update or modify this policy at any time. Changes will be posted on this page with an updated effective date. The policy in effect at the time of your purchase governs that transaction. It is your responsibility to review this policy before each purchase.
